I am in the middle of a business venture that has the potential of making me very wealthy. I have an agent who has ?shopped? my project to different networks and seems to be doing everything right. But then he presented me with a contract that named him the ?co-producer? of my project. Long story short, this person signed on as my agent and I?m just curious as to what?s the average percentage for a entertainment agent and what?s does the title ?co-producer? entitle a person to dollar wise. After speaking to others on the web, I found the answer. Producer and co-producer can be anything from simply a title to actually being very active in getting everything and everyone gathered together to have a project launched. People in the industry don?t take the title seriously, then, unless the person holding that title can back it up with credentials showing they were active in the projects in which they held that title, and unless those projects were also successes. The short of it is that unless they also negotiate an extra salary, wage or percentage of anything they are ?co-producer? of, then they aren?t entitled to any extra money. The real problem with making them contractually co-producer of your future projects is that they might try to have a say in what happens with those projects when you don?t want this, or try to sway the direction of your career to where you don?t want it to go. Plus, they might try to gain more money from you later should things go well for you. If this is simply a contract for a single project, then you should make certain it spells out his obligations and set a specific amount for that single project. I would not give him more than five percent of net along with his agent fees for him being a co-producer, if you are going to give him a percentage instead of a flat fee. If the contract is for more than a single project, then make certain a clause is in it stipulating that a fee will be paid him on a contract to contract basis, to be negotiated for each project.
